Bragwise Terms of Service

These Terms of Service (the “Terms”) govern your use of the Bragwise mobile application (the “App”), published under the application identifier se.atte.bragwise. By creating an account, using the App as a guest, or otherwise accessing the App, you agree to these Terms. If you do not agree, do not use the App.

1. What Bragwise is

Bragwise is a social prediction game where users create and join prediction challenges, make picks, compete on leaderboards, and connect with friends. Bragwise is for entertainment only. It is not a gambling, betting, wagering, or money-staking service. No real money, cryptocurrency, or items of monetary value are wagered, won, or paid out through the App. “Bets”, “points”, and “predictions” in the App have no monetary value and cannot be exchanged for anything of value.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Bragwise. By using the App you confirm that you meet this requirement and that you have the legal capacity to agree to these Terms.

3. Your account

• You are responsible for activity that happens under your account.
• You agree to provide accurate information and to keep your sign-in email secure.
• You may not impersonate another person or misrepresent your identity.
• You may not create accounts by automated means or operate accounts to abuse, spam, or disrupt the service or other users.

4. User-generated content

Bragwise lets you create challenges, titles, descriptions, options, display names, usernames, and other content (“User Content”). You are solely responsible for the User Content you create, publish, or share. Bragwise does not pre-screen, author, endorse, or verify User Content, and the views expressed in User Content are those of the user who posted it, not of Bragwise.

You retain ownership of your User Content. By publishing User Content you grant Bragwise a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute that content within the App solely for the purpose of operating and providing the service (for example, showing your challenge to other participants).

5. Prohibited content and conduct

You agree not to create, publish, share, or solicit content that:

• Is illegal, or promotes or facilitates illegal activity;
• Is hateful, harassing, threatening, or discriminatory toward any person or group (including on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or any other protected characteristic);
• Is defamatory, libellous, or invades another person’s privacy;
• Is sexually explicit, pornographic, or sexualises minors;
• Depicts, encourages, or facilitates violence, self-harm, terrorism, or other serious harm;
• Infringes the intellectual-property, privacy, or other rights of any third party;
• Contains malware, spam, scams, or attempts to phish or defraud other users;
• Constitutes real-money gambling, betting, or solicitation of wagers;
• Discloses another person’s private or personal information without their consent.

You also agree not to reverse-engineer, abuse, overload, or attempt to gain unauthorised access to the App, its backend, or other users’ accounts.

6. Moderation, suspension, and termination

We may, at our sole discretion and without prior notice, remove any User Content, and suspend or permanently terminate any account, that we believe violates these Terms, is unlawful, or is harmful to other users or to Bragwise. We are not obligated to monitor User Content but reserve the right to do so. You may stop using the App and delete your account at any time, as described in our Privacy Policy.

7. Reporting violations

If you encounter User Content or conduct that violates these Terms — including content you believe is illegal, discriminatory, or infringes your rights — report it to us at naquden@duck.com. We will review reports and take action we consider appropriate, which may include removing content or terminating accounts. Please include enough detail (such as the challenge title or username) for us to locate the content.

8. Intellectual-property complaints

If you believe content in the App infringes your copyright or other intellectual-property rights, send a notice to naquden@duck.com that identifies the work, the infringing content in the App, your contact details, and a statement that you have a good-faith belief the use is not authorised. We will respond to valid notices, including by removing infringing content where appropriate.

9. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that User Content is accurate, lawful, or reliable. You use the App and rely on User Content at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, Bragwise and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App or any User Content. We are not responsible for User Content created by users, including content that is illegal, discriminatory, offensive, or otherwise objectionable. To the extent liability cannot be excluded, our total aggregate liability is limited to the amount you paid us to use the App (which, for a free app, is zero).

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnity

You agree to indemnify and hold harmless Bragwise and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the App, or your violation of these Terms or of any law or third-party right.

12. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above when we do, and significant changes will be communicated through the App where appropriate. Continued use of the App after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules. To the extent permitted by law, disputes shall be subject to the courts of Sweden. This does not deprive you of any mandatory consumer-protection rights you have under the law of your country of residence.
